1. Scope of Agreement & Company Disclosures

These Terms and Conditions of Sale (hereinafter “T&C”) govern all online orders and sales contracts concluded between JODY BOIS (hereinafter “the Seller”, “we”, or “us”) and any consumer or business customer (hereinafter “the Buyer” or “Customer”) through the website firmbois.ouezcorp.com.

2. Products, Wood Moisture & Energy Standards

JODY BOIS supplies premium certified solid biofuels on pallet:

• Kiln-Dried Firewood: High-grade hardwood logs (beech, oak, ash, hornbeam) kiln-dried to guaranteed core moisture below 20%, ensuring optimal clean combustion and immediate readiness for use.
• Certified Wood Pellets: 100% virgin softwood pellets, certified DINplus (Reg. 7A) and ENplus A1, calorific value ≥ 4.9 kWh/kg, ash content < 0.7%.
• Compressed Wood Briquettes: High-density extruded biomass briquettes offering long-lasting heat dissipation.

Natural characteristics: Natural variations in bark texture, grain, and color are intrinsic to solid wood products and do not constitute non-conformity.

3. Pricing, Taxes & 100% Free Tail-Lift Delivery

All prices displayed on the store are denominated in Euros (€) and inclusive of value-added tax (VAT) at applicable European rates.

Transparent pricing: Standard delivery is 100% free of charge for all pallet orders within our regular European delivery zones. No hidden handling fees or fuel surcharges are applied at checkout.

4. Ordering Process & Contract Formation

The order is completed when the Customer selects products, reviews cart contents, provides accurate delivery and contact details (including a valid mobile phone number for freight notification), accepts these T&C, and executes payment. A formal order confirmation is transmitted immediately via email.

5. Payment Methods & Secure Processing

We offer secure payment solutions: SEPA Bank Wire Transfer, Credit/Debit Cards (Visa, Mastercard, Maestro, American Express) with 3D-Secure 2.0 verification, and PayPal. Card details are tokenized and processed exclusively by PCI-DSS certified payment gateways.

6. Heavy Freight Delivery & Site Access Requirements

Due to the heavy palletized nature of our merchandise (800 to 1,050 kg per pallet), delivery is carried out by specialized heavy freight carriers:

• Prior Phone Notification: The carrier contacts the Customer in advance to schedule a delivery appointment window.
• Tail-Lift & Pallet Truck Unloading: Offloading is conducted curbside on flat ground using a hydraulic tail-lift and pallet jack.
• Access Road Viability: The Customer must ensure that the access road permits heavy trucks (18 t to 26 t gross weight) without sharp turns, steep slopes, low weight-restricted bridges, or unpaved muddy roads.

7. Parcel Acceptance, Inspection & Damage Claims

Upon delivery, the Customer must inspect the pallets for count and integrity. Any damage to packaging or goods must be recorded with specificity on the driver’s consignment note (CMR) and reported to JODY BOIS with photos within 48 to 72 hours at infos@jodybois.com.

8. Right of Withdrawal & 30-Day Return Guarantee

Beyond the statutory 14-day EU right of withdrawal, JODY BOIS grants an extended 30-day return policy. Items must be returned in their original undamaged shrink-wrapped condition on their original pallet. For details and pickup logistics, refer to our Return and Refund Policy.

9. Statutory Conformity & Latent Defect Warranties

Consumers benefit from statutory conformity warranties (minimum 2 years from delivery) and guarantees against latent defects pursuant to applicable EU consumer protection directives.

10. Retention of Title & Risk Transfer

Goods remain the property of JODY BOIS until full payment is received. Risk of loss passes to the consumer upon physical handover of the goods by the carrier.

11. Limitation of Liability & Force Majeure

JODY BOIS is not liable for delivery failures resulting from force majeure events, including extreme snow storms, road blockades, severe weather bans, or incorrect delivery access information provided by the Customer.

13. Customer Support, Consumer Mediation & ODR

14. Governing Law & Jurisdiction

These terms are governed by the laws of France. Commercial disputes are subject to the exclusive jurisdiction of the Commercial Court of Paris, without prejudice to mandatory local consumer protection rules.
